Is sexting illegal in Malaysia?

Came across a very interesting question: Is sexting illegal in Malaysia?

Short answer: technically yes.


Yet doing this (Bahasa SMS) is not illegal.

There are a few laws in Malaysia where one can get into trouble with sexting:



Sections 211 and 233 of the Communications and Multimedia Act 1998

Sections 211 of the Communications and Multimedia Act 1998 reads as:

(1) No content applications service provider, or other person using a content applications service, shall provide content which is indecent, obscene, false, menacing, or offensive in character with intent to annoy, abuse, threaten or harass any person.

(2) A person who contravenes subsection (1) commits an offence and shall, on conviction, be liable to a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding one year or to both and shall also be liable to a further fine of one thousand ringgit for every day or part of a day during which the offence is continued after conviction.

Essentially anyone who uses a "content applications service" in an "indecent [and] obscene" manner commits an offence.

So if SMS is not a "content applications service"? Or OTT messaging services (like Whatsapp)?

Well, section 233 of the Communications and Multimedia Act 1998 would close that loop:

(1) A person who —

(a) by means of any network facilities or network service or applications service knowingly —

(i) makes, creates or solicits; and

(ii) initiates the transmission of,


any comment, request, suggestion or other communication which is obscene, indecent, false, menacing or offensive in character with intent to annoy, abuse, threaten or harass another person; or


(b) initiates a communication using any applications service, whether continuously, repeatedly or otherwise, during which communication may or may not ensue, with or without disclosing his identity and with intent to annoy, abuse, threaten or harass any person at any number or electronic address,

commits an offence.

(2) A person who knowingly —

(a) by means of a network service or applications service provides any obscene communication for commercial purposes to any person; or

(b) permits a network service or applications service under the person 's control to be used for an activity described in paragraph (a),

commits an offence.

(3) A person who commits an offence under this section shall, on conviction,be liable to a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding one year or to both and shall also be liable to a further fine of one thousand ringgit for every day during which the offence is continued after conviction.

Section 233 of the Communications and Multimedia Act 1998 has been interpreted VERY broadly, scooping up bloggers, Malaysia-Today, fan fiction. people who insult the Sultan of Perak, cartoonists, people who call the rules "fornicating"Zaid Ibrahim, "businessmen", forex traders, whatever the heck this was, insulting Johor royalty, mentally ill people, etc

Honestly it could be extended to sexting without too much imagination.


Section 292 of the Penal Code 

Section 292 of the Penal Code deals with "obscenity". In part, it criminalises:
Whoever— (a) sells, lets to hire, distributes, publicly exhibits or in any manner puts into circulation, or for purposes of sale, hire, distribution, public exhibition or circulation makes, produces or has in his possession any obscene book, pamphlet, paper, drawing, painting, representation or figure or any other obscene object whatsoever
Try not to get too descriptive eh?


Section 11 of the Sexual Offences Against Children Act 2017 

The section speaks for itself:
(1)  Subject  to  subsection  (3),  any  person  who—
         (a)         sexually  communicates  with  a  child;  or
         (b)         encourages  a  child  to  sexually  communicate,
 
by  any  means,  commits  an  offence  and  shall,  on  conviction,  be  punished  with  imprisonment  for  a  term  not  exceeding  three  years

    (2) For the purposes of this section, a person is said to sexually communicate  if—
         (a)         the  communication  or  any  part  of  the  communication  relates  to  an  activity  that  is  sexual  in  nature;  or
         (b)         any  reasonable  person  would  consider  any  part  of  the  communication  to  be  sexual.

Unlike the Penal Code, which defines a minor as 16 years of age, (but see the Child Act 2001, which defines a "child" as someone under 18), the Sexual Offences Against Children Act 2017 applies to anyone who is under 18.


So yes, technically sexting would run afoul of some Malaysian laws.

[A]mong calls the Foreign Office fielded this year were questions about the plot of the 1995 Mel Gibson movie Braveheart and queries about the BBC TV show Strictly Come Dancing. Other callers asked about vampires in Poland, Bangkok massage parlour costs, and potential marriage partners in Argentina.

The man pursuing information about vampires explained that a woman he met online asked about his blood type before meeting for a first date. In the Canary Islands, a caller wanted the office to intervene when a cat urinated on his hotel room bed, while a man in New Delhi heard the British High Commission was selling vegetarian sausages and wanted to buy some.

Australia: 20 bizarre calls from travellers to DFAT

Here are some of the more bizarre requests DFAT has received from Australians travelling abroad.

1. A traveller who was destitute refused to return to Australia without their pet, which could not be returned for quarantine reasons.

2. A mother who wanted the embassy in Bangkok to book accommodation and a return ticket to Australia for her son, then provide an embassy driver to take him to the airport.

3. A request from an Australian traveller for DFAT to feed her dogs while she was away.

4. I'm attending a conference overseas with a large group of Australians but I have heard it is a dangerous city. Can the High Commission arrange for a risk assessment and some armoured cars? We only need them for a week.

5. Multiple inquires to embassies overseas as to the closest pub televising the State of Origin game.

6. An Australian who had his laptop stolen overseas requested that embassy staff pick him up from the airport, loan him a laptop and provide him with office space for a few days.

7. A traveller who asked whether the sand in Egypt would affect her asthma.

8. Panicked callers regularly reporting Australian travellers missing overseas, after not hearing from them within the first few hours of arriving in country. Consular officers usually explain that getting through customs and immigration can take time.

9. Why won't the Australian embassy come and pack my bags for me? I'm an 80-year-old travelling by myself and too old to pack my own bags.

10. I left some items on an aircraft when I changed flights. Can the embassy collect it from the airline's lost property?

11. Can the embassy obtain prescription medicine from Australia and send it to me so I can continue my holiday?

12. Requests for our embassies to store luggage, hold mail, provide banking facilities or arrange tours for Australian travellers.

13. What is the best way to get a polecat out of your roof?

14. I'm going on a cruise. What will the food be like? Can you drink the water on the ship?

15. Some travellers evacuated from civil unrest in Egypt on government-funded flights questioned why they were not entitled to frequent flyer points. Similarly, some travellers evacuated from the 2004 Boxing Day tsunami made seat requests (including for first class).

16. A caller to DFAT's 24-hour Consular Emergency Centre wanted to know the average salary for an expat to expect in Thailand.

17. Does the embassy know if there are there any hotels in Phnom Penh with vacant rooms?

18. Can the embassy tell the local police that I have an excellent driving record in Australia and should not have to pay those outstanding speeding fines?

19. What is the best hotel in Phuket?

20. On my last trip to the Philippines I had some trouble with the law. What is the number of the embassy in Manila so I can call them to get me out of jail when I go back?


Singapore: Singaporeans can be a demanding lot when dealing with consular officers overseas

One Singaporean asked for help to get refunds for unsatisfactory, illegal sexual services sought abroad while another asked for the launching of an investigation into a case of alleged racism after being served a smaller piece of chicken than the locals at a fast food chain overseas.

Another unusual request from a Singaporean man was for officers to convince his foreign girlfriend to quicken her divorce proceedings so he could marry her.

People who breed should be required to obtain a licence before they can have kids. And they should be required to pay a tax for every life they bring into this world. Indexed to medical inflation to pay for the mental health support that is required when people need to deal with them.
